General terms and conditions of business

Scope
The following terms and conditions apply to all contracts concluded between Redbox Studios (represented by Jonas Zellner) and its customers, including the services of Redbox (RDBX.de), Podiv - Podcast Agency, Podcaststudio.berlin, and jonaszellner.de, as well as all verbal and written agreements with the person Jonas Zellner, residing at Großbeerenstreet 169a,12277 Berlin, and Paul-Schneider Str. 29, 14513 Teltow.

Scope of Services
Redbox Studios offers its customers the use of an audio studio or podcast & content studio with high-quality equipment and a customer reception area. The studio is under video surveillance.

Cancellation
Cancellations are free of charge if made at least 72 hours before the agreed-upon appointment. A fee of 50% of the agreed price will be charged for cancellations made up to 24 hours before the appointment. Cancellations made less than 24 hours before the appointment will result in the full price being charged.

Overtime Fees
If the booked time is exceeded, a fee of €100 per started 15 minutes will be charged.

(Enterprise is excluded; overdraft fees are adjusted according to the terms and conditions.)

Prohibition of Eating and Drinking
Eating and drinking in the studio are prohibited to avoid damage to the high-quality equipment.

Incorrect Booking Selection
In the event that the customer makes an incorrect selection during booking, Redbox Studios reserves the right to charge an additional fee if necessary.

Guests and Number of Persons
The customer undertakes not to bring unannounced guests into the studio and not to exceed the maximum number of persons stated at the time of booking.

Cancellation by Redbox Studios
Redbox Studios reserves the right to cancel appointments without giving reasons. In such a case, the customer will receive a full refund of the amount already paid.

Transfer of Files and Payment
The transfer of files will only take place after full payment has been received. Until then, we reserve the right to retain the recorded material and, if necessary, delete it.

Prices

All prices stated on the website and in any communication are net prices plus the statutory value-added tax (VAT) of 19%, unless explicitly stated otherwise.

Deletion of Files
To save resources and ensure the efficiency of our system, files sent to customers will be automatically deleted from our servers after 30 days. Please note that these files cannot be recovered after deletion.

Prohibition of Personal Audio Recording
It is strictly prohibited to make independent audio recordings during a session. In case of violation, a penalty of €1000 will be charged.

Choice of Technology, Sets, and Recording Environment
The selection of technology, sets, and recording environment can be changed and adjusted by the client at any time with appropriate justification. The contractor has no right to a specific choice of technology or recording environment, even if it has been previously agreed upon or booked.

Use of the Client's Name and Logo
The use of the client's name and logo for advertising purposes is permitted to the contractor unless expressly prohibited.

Use of Photo and Video Material for Reference and Promotional Purposes

Redbox Studios is entitled to use photos and short video sequences without audio, created during the course of a booking and from studio operations, free of charge and without time limitation, as references on its own website, google and on its own social media channels. This includes naming the client as well as quotes or statements made by the client in connection with the collaboration.
This does not include the publication of complete videos, complete episodes, or other coherent excerpts of recordings with audio. Only individual stills or short, silent image excerpts will be used.
The client may object to this use at any time, in whole or in part, without giving reasons, and without any particular form required (e.g. by email or message). Upon receipt of the objection, Redbox Studios will promptly remove the affected content from its website and social media channels.
Any distribution already made by third parties (e.g. sharing, screenshots, search engine caching) is beyond Redbox Studios' sphere of influence and is not covered by the deletion obligation.
The placement of images and text for promotional purposes for Redbox Studios, Redbox Mobil, Podiv, Podcaststudio.berlin, or Jonas Zellner is generally permitted within the scope of the preceding paragraphs. Subsequent requests to change already published advertising (branding) can only be implemented by mutual agreement and against payment of a corresponding fee.

Recording in the Studio with a specific Set

The recordings in the studio will preferably be carried out in Set A, unless explicitly requested otherwise and the recordings are not affected by external influences such as noise from rain or neighbors. We reserve the right to implement the recording in Set A, even if explicit requests for other sets have been made. When booking, Sets B and C can only be requested but are not obligatory for the studio to adhere to.

Disclaimer
Loss of Data: Redbox Studios assumes no liability for the loss of data or information arising from the use of our services or in connection therewith. Customers are responsible for regularly backing up their data. We strongly recommend creating backups of important files regularly to avoid losses.

Data Retention after 3 Months: Customers are advised that Redbox Studios does not guarantee permanent storage of data. Files and information provided or created through our services may be deleted after a period of three months. It is the responsibility of customers to ensure that they make copies of their data in a timely manner before it is deleted.

Errors in Shop and Booking Procedures:

Redbox Studios strives to provide accurate and up-to-date information in our shop and booking procedures. However, we do not accept liability for errors or inaccuracies in the information, including but not limited to prices, availability of services, or technical specifications. Customers are encouraged to carefully review all information and contact us in case of uncertainties or errors.

Final Provisions
German law applies. Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a provision shall be deemed to have been agreed that comes closest to the economic purpose of the invalid provision. Changes or additions to these terms and conditions require written form.
